Drunk man fined after asking two teens back to his home at Irvine takeaway

An Irvine man who asked two 15-year-old girls if they wanted to go home with him was fined £550 last week.

Mark Kelly, 38, of Lugton Court, pleaded guilty to acting in a threatening or abusive manner at the Taste of India takeaway in Bank Street, Irvine, on February 18 by making inappropriate remarks towards the youngsters.

Katy McColl, prosecuting, told Kilmarnock Court that the two girls were in the shop shortly before 11pm when they were approached by Kelly.

He asked: “Do you want to come back to mine?”

Both said no and asked the accused what age he was.

He told them that he was 40.

Ms McColl said: “Both children were scared by the accused and told a shop worker they were scared.”

Kelly left, but stood outside against a railing.

The two girls believed that he was waiting for them.

Ms McColl said: “The shop worker told them to remain within the shop and he would alert the police.”

Officers arrived to find the girls “visibly shaken”.

When they spoke to Kelly, he told them : “They’ve got nice a***s.”

He also repeatedly stated that he was drunk and wanted to go home.

“The officers didn’t believe he was heavily under the influence of alcohol,” said Ms McColl.

James Irvine, defending, said that Kelly had been out for the evening in Irvine town centre.

He said: “He went into the takeaway opposite the pub he was in and made these fairly silly, fairly stupid comments.

“He didn’t know the age of the girls when he spoke to them.”

Mr Irvine said that Kelly was a steel erector, working at various locations around the country.

Fining Kelly, Sheriff Elizabeth McFarlane told him: “It seems to me that some of the things you say get you into trouble.”
